ESMA Guidelines for reporting under EMIR – applicable from 29 April 2024
The European Securities and Markets Authority (ESMA) has issued Guidelines (ESMA74-362-2281) for reporting under the European Market Infrastructure Regulation (EMIR).
The Financial Supervisory Authority (FIN-FSA) has confirmed it will comply with the Guidelines.
In accordance with Article 16(3) of the ESMA Regulation1, financial market participants shall make every effort to comply with ESMA’s guidelines.
Application
The Guidelines will apply in relation to the derivatives reporting obligation as stated in Article 9 of EMIR and the trade repositories’ obligations as under Articles 78 and 81 of EMIR.
Date of application
The Guidelines will apply from 29 April 2024.
