ESMA has published a statement concerning sustainability reporting and a report on procedures for the enforcement of sustainability information

The European Securities and Markets Authority (ESMA) has published a statement on the application of the European Sustainability Reporting Standards (ESRS) and a report on procedures for the enforcement of sustainability information. In 2025, large public-interest entities will publish their first sustainability reports in accordance with the ESRS, and their enforcement begins. Enforcement will be harmonised by ESMA’s enforcement guidelines.

To promote the implementation of the new requirements, in its statement on sustainability reporting, ESMA wants to i) point to elements of guidance by the European Commission and EFRAG; and ii) highlight certain key areas it finds important for companies preparing for upcoming sustainability reporting. ESMA Guidelines for national competent authorities on enforcement of sustainability information build on the Guidelines on enforcement of financial information. Therefore, the enforcement of sustainability information will be, as a rule, similar to the already well-established IFRS enforcement of listed companies.
